Power of Attorney

A Will should always be looked at in conjunction with a Power of Attorney, and in many instances it is more prudent to consider a Power of Attorney than a Will.

When the time comes and the deceased's estate is due for wrapping up pursuant to the terms of the Will, or if there is no Will then according to the laws of Intestacy, it is prudent to perform services in a timely fashion, which in itself is a difficult task, as it is important not to be too pushy at what can be a sensitive times.

Estate Litigation


Whether it is desirable or not, there are many instances where Wills should be contested through the courts, where the deceased has not given due consideration to the persons who it should have been protected by, the terms of the Will - a financial benefit.

Whilst such litigation is sometimes seen to be against the wishes of the deceased, ultimately the courts have proven time and time again that had the deceased properly considered those around them at the time of making their Will, a different Will would have been written.
