Leasing Leasing generally refers to a written lease/tenancy by a business operator for a premises for a fixed term for a commercial use. A proposed lease often contains a multitude of terms/clauses that must be reviewed and considered to ensure all reasonable eventualities are covered. Leases may be accompanied by guarantees from third parties. Duty (Stamp Duty) is payable, in addition to any registration of lease fees payable to the Land Titles Office. There will also be Land Titles Office search fees and possibly survey costs. The Retail Shop Leases Act & Regulations provide a comprehensive description of mandatory disclosure of salient terms between lessor and lessee. Generally disclosure is from the proposed lessor to proposed lessee, however the lessor may require disclosure of information. Our involvement prior to the entry into a lease by a lessee is of particular advantage. A properly formulated and well-planned lease, whether for lessee or lessor, should remove, as much as possible, the avenues for dispute between lessor and lessee due to poor wording and lack of understanding of terms.
